This draft is intended as a compliance-oriented template for creator onboarding. It should be reviewed against the Platform's actual business model, applicable law, and any additional requirements imposed by the acquiring bank, payment processor, Visa, Mastercard, or other payment network before publication.
1. Scope, Parties and Acceptance
1.1 These Creator Terms & Conditions ("Creator Terms") form a legally binding agreement between Egyzxy Kft., the operator of vosfemmes.com (the "Platform", "we", "us" or "our"), and the individual or legal entity registering, uploading, publishing or otherwise providing content through the Platform (the "Creator", "you" or "your").
1.2 These Creator Terms apply in addition to the Platform Terms of Use, Privacy Policy, Content Policy, Community Guidelines and any other policies expressly incorporated by reference. If there is a conflict concerning Creator activities, these Creator Terms prevail to the extent of that conflict.
1.3 By checking the box stating that you agree to these Creator Terms and completing registration, you confirm that you have read, understood and accepted them. The acceptance box must be actively selected by you and may not be pre-selected on your behalf.
1.4 If you create an account on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and references to "you" include that entity.
2. Eligibility, Age and Identity Verification
2.1 You must be at least eighteen (18) years old and have reached the age of legal majority in every jurisdiction relevant to your use of the Platform.
2.2 You must provide accurate, complete and current registration information and must not impersonate another person or use false, misleading or fraudulent identity information.
2.3 You agree to complete any age, identity, liveness, address, sanctions, fraud-prevention or other verification checks that we or our service providers reasonably require.
2.4 We may request additional documentation at any time, including government-issued identification, proof of address, tax information, banking information, model releases, consent records or other evidence required to establish eligibility and compliance.
2.5 You may not permit another person to use your Creator account to publish content without our prior authorization and completion of any required verification.
3. Creator Account Responsibilities
3.1 You are responsible for maintaining the confidentiality and security of your credentials and for all activity conducted through your Creator account.
3.2 You must promptly notify us of unauthorized access, suspected compromise, fraud, coercion, account takeover or any material change affecting your eligibility.
3.3 You must keep your profile, identity, payment and tax information accurate and up to date.
3.4 You must not sell, transfer, rent or otherwise make your Creator account available to another person without our written approval.
4. Content Standards and Prohibited Content
4.1 You may upload, publish or otherwise make available only content that is lawful, consensual, authorized and compliant with these Creator Terms and all Platform policies.
4.2 You must not upload, publish, request or otherwise make available content that:
- depicts, sexualizes or exploits any person under 18 years of age, or any person whose age cannot be reliably established as 18 or older;
- constitutes or appears to constitute child sexual abuse material (CSAM) or any other sexual content involving minors;
- depicts or promotes sexual activity, nudity or intimate conduct without the free, informed and documented consent of every depicted participant;
- is produced, obtained or distributed through coercion, trafficking, exploitation, blackmail, fraud, intoxication, incapacity or abuse of vulnerability;
- depicts real sexual violence, non-consensual sexual acts, revenge pornography, hidden-camera sexual content or intimate content distributed without authorization;
- contains unlawful prostitution, trafficking, exploitation or other unlawful sexual services or solicitation, where prohibited by applicable law;
- infringes copyright, trademark, privacy, publicity, image, data-protection or other rights of any third party;
- contains illegal goods, services, instructions or activity, or otherwise violates applicable law or payment-network requirements;
- contains malware, deceptive links, scams, impersonation, payment circumvention or fraud;
- has been prohibited by the Platform, an acquiring bank, payment processor, Visa, Mastercard or another applicable payment network.
4.3 If you are uncertain whether content is permitted, you must not publish it until you have obtained written clarification from the Platform.
5. Persons Appearing in Content: Age, Consent and Records
5.1 Before creating, uploading or otherwise making available content depicting any other person, you must verify that every depicted person is at least 18 years old and has legal capacity to consent.
5.2 You must obtain the depicted person's express, informed and voluntary consent to: (a) participate in the content; (b) be photographed, recorded or filmed; (c) have the content uploaded and displayed on the Platform; and (d) have the content distributed in the manner offered by the Platform.
5.3 Where applicable, your consent documentation must also cover promotional use, previews, thumbnails, excerpts, geographic distribution, subscriber access, downloads or other uses you enable.
5.4 You must keep reliable records proving age, identity and consent for every depicted participant for as long as the content remains available and for any additional period required by applicable law, our policies, our payment partners or a lawful request.
5.5 Upon request, you must promptly provide us or our designated compliance service provider with sufficient evidence of age, identity, authority and consent. We may restrict or remove content while such evidence is reviewed.
5.6 Consent must be capable of being withdrawn to the extent required by applicable law. You must immediately inform us if a depicted person disputes consent, age, authorization or continued publication.
6. Ownership and Rights in Creator Content
6.1 As between you and the Platform, you retain ownership of intellectual property rights you validly hold in your Creator Content.
6.2 You represent and warrant that you own, control or have obtained all rights, permissions, releases and licenses necessary to upload, display, transmit and otherwise use your Creator Content through the Platform.
6.3 You grant the Platform a non-exclusive, worldwide, royalty-free, sublicensable and transferable license, for the period your content is made available through the Platform and for a reasonable archival, evidence and compliance period thereafter, to host, reproduce, encode, transcode, store, display, communicate, distribute and technically adapt your Creator Content as necessary to operate, secure, market and provide the Platform.
6.4 Where you expressly enable promotional tools, previews or off-platform marketing, the license includes the limited right to use the corresponding content for those enabled promotional purposes, subject to applicable law and your settings.
6.5 You must not upload content if doing so would breach an exclusive license, employment obligation, agency agreement, performer agreement or other third-party restriction.
7. Moderation, Review and Removal
7.1 We may use automated and human review processes to assess Creator Content, account activity, transactions and supporting records for safety, legality, fraud prevention and compliance.
7.2 We may reject, restrict, geoblock, remove or disable access to any content that we reasonably believe violates these Creator Terms, Platform policy, applicable law or payment-network requirements.
7.3 We may immediately preserve relevant records and report suspected illegal content or activity to competent authorities, hotlines, payment partners or other entities where required or permitted by law.
7.4 Removal from public view does not necessarily require immediate deletion from compliance, evidence, fraud-prevention, accounting, dispute or legal-hold systems.
8. Payments, Refunds and Chargebacks
8.1 You authorize the Platform and its payment service providers to process transactions, calculate applicable fees, issue refunds where required, manage disputes and chargebacks, and make permitted deductions from Creator balances.
9. Complaints, Takedowns and Cooperation
9.1 You agree to cooperate promptly with complaints and investigations concerning age, consent, identity, copyright, privacy, illegal content, fraud, trafficking, exploitation or payment disputes.
9.2 We may temporarily disable content immediately upon receiving a credible complaint concerning age, consent or unlawful intimate content while we investigate.
9.3 You must not retaliate against, threaten, harass or attempt to silence any person who reports content or raises a good-faith concern.
9.4 You must preserve relevant source files, communications, releases and verification records while an investigation, dispute, legal hold or regulatory request is pending.
10. Compliance with Laws and Payment-Network Requirements
10.1 You must comply with all laws, regulations and legally binding orders applicable to your Creator activity, content, advertising, payments, taxes, data processing and consumer interactions.
10.2 You must also comply with the Platform's reasonable requirements designed to satisfy the rules, monitoring programs and lawful instructions of our acquiring banks, payment processors and card networks, including Visa and Mastercard.
10.3 You must not knowingly submit, cause or facilitate any transaction that is illegal or that you know or reasonably should know relates to illegal activity.
10.4 We may introduce, modify or strengthen verification, consent, content-review, recordkeeping, transaction-monitoring or other controls when reasonably necessary to comply with applicable law or payment-network requirements.
11. Representations and Warranties
11.1 Each time you upload, publish or otherwise provide Creator Content, you represent and warrant that:
- you are legally entitled to provide the content;
- every depicted person is an adult whose age has been verified;
- every depicted person freely and validly consented to the creation, publication and distribution of the content;
- you possess and will maintain sufficient documentary evidence of the required rights, identity, age and consent;
- the content does not violate applicable law, these Creator Terms, Platform policies or third-party rights;
- the content and related transactions do not involve trafficking, coercion, exploitation, fraud or unlawful activity;
- all information you provide to the Platform concerning the content, participants, rights and your identity is truthful and not misleading.
12. Indemnification
12.1 To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless the Platform, its affiliates, directors, officers, employees and service providers from third-party claims, losses, liabilities, penalties, damages and reasonable costs arising from your breach of these Creator Terms, your Creator Content, your violation of another person's rights, or your unlawful or fraudulent activity.
13. Suspension and Termination
13.1 We may suspend, restrict or terminate your Creator account if we reasonably believe you have violated these Creator Terms, created material legal or payment risk, failed verification, provided false information or failed to cooperate with a compliance investigation.
13.2 We may take immediate action without prior notice where reasonably necessary to protect a person from harm, prevent illegal activity, comply with law, preserve evidence or satisfy a payment-network or acquiring-bank requirement.
13.3 Termination does not affect accrued rights, unresolved disputes, chargebacks, reserves, legal obligations or provisions that by their nature should survive termination.
14. Privacy and Personal Data
14.1 We process personal data in accordance with our Privacy Policy and applicable data-protection law.
14.2 You acknowledge that age, identity, consent and compliance verification may require the processing of sensitive identity documents, biometric or liveness information, transaction data and records relating to persons appearing in Creator Content, where permitted by applicable law.
14.3 Where you provide personal data about another person, you represent that you have a lawful basis and authority to provide that data and that you have given any required notices.
15. Changes to These Creator Terms
15.1 We may update these Creator Terms to reflect legal, regulatory, safety, product or payment-network changes.
15.2 Where required by law or where a change is material, we will provide reasonable notice and may require you to actively accept the updated version before continuing to publish content.
15.3 We may keep auditable records of the version accepted by you, the date and time of acceptance, your account identifier, and relevant technical evidence of acceptance.
16. Limitation of Liability
16.1 To the maximum extent permitted by applicable law, the Platform will not be liable for indirect, incidental, special, consequential or punitive damages arising from Creator activity, content removal, account suspension, payment-partner action or service interruption. Any mandatory consumer, employment, performer, data-protection or other rights that cannot lawfully be excluded remain unaffected.
17. Governing Law and Disputes
17.1 These Creator Terms are governed by the laws of Hungary, without prejudice to mandatory rights that apply regardless of choice of law.
17.2 The courts of Budapest, Hungary shall have jurisdiction over disputes arising from these Creator Terms, except where mandatory law requires another forum.
18. General Provisions
18.1 If any provision is held invalid or unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law.
18.2 Our failure to enforce a provision does not waive our right to enforce it later.
18.3 You may not assign or transfer these Creator Terms or your Creator account without our prior written consent. We may assign these Creator Terms as part of a merger, reorganization, financing, sale of business or transfer of the Platform, subject to applicable law.
18.4 Electronic acceptance of these Creator Terms has the same effect as a written signature to the extent permitted by law.
